      The Health Service Executive gives notice of its intention to proceed under Article 32(4) of Directive 2014/24/EU following an unsuccessful Restricted Procedure previously published under CFT ID 3587266. Only one tender was received. Negotiations with the tenderer did not result in agreement due to the tenderer’s inability to accept mandatory contractual terms relating to buy-out provisions, step-in rights, termination rights and long-term governance obligations required by the HSE.
