A Kommentár Alapítvány audiovizuális és rendezvénytechnikai eszközöket szerez be hét részben, melyek magukban foglalják a videótechnikát, LED posztert, hangtechnikát, fénytechnikát, mobil színpadot, konferencia mikrofon + PTZ kamera rendszert és tolmácstechnikát. A szállítás és beüzemelés Budapesten történik, és a kezelő személyzet oktatását is magában foglalja. A szerződés teljesítési ideje 45 nap. Az ajánlatokat az ár (53,8462%) és a vállalt teljesítési határidő (23,0769%) alapján bírálják el. A pénzügyi alkalmasság igazolásához az ajánlattevőnek az eljárást megindító felhívás feladását megelőző három lezárt üzleti évben legalább nettó 65 000 000 Ft árbevételt kell igazolnia az 1. rész esetében. A műszaki alkalmasság igazolásához az ajánlattevőnek az elmúlt 36 hónapban legalább 10 m2 beltéri LED panel szállítására vonatkozó referenciával kell rendelkeznie az 1. rész tekintetében.

Description
The tenderer is unsuitable for the performance of the contract from an economic and financial point of view if, in the three financial years preceding the publication of the call for tenders, its total turnover, excluding VAT, does not reach at least HUF 65,000,000 for Part 1. The GP.1. suitability requirement may be met jointly by joint tenderers, i.e. turnover data may be aggregated. In the case of tendering for several parts, the requirements are not cumulative, it is sufficient to meet the above turnover requirement for the highest value among the parts concerned by the tender. If the tenderer does not have the document according to GP1. because it operates in a legal form for which it is not possible to submit a turnover statement, it may prove its financial and economic suitability with any other statement or document deemed appropriate by the contracting authority instead of the suitability requirement and method of proof according to GP1. The tenderer is obliged to substantiate during the request for additional information that it operates in a legal form for which it is not possible to submit a turnover statement and to request information on the method of proving suitability accepted by the contracting authority instead of the suitability requirement and method of proof according to GP1. If the tenderer cannot provide the turnover data according to point GP1. for the entire period prescribed by the contracting authority because it started its operation after the beginning of the period, it is entitled to prove its suitability with the turnover data for the period after the start of its operation. For economic operators established later, the contracting authority does not specify a turnover requirement different from that applicable to all tenderers.
Documentation Requirement
The tenderer must prove in advance in its tender, by submitting the ESPD provided in the procurement documents, that it meets the suitability requirements specified in this point on the basis of Section 65 of the Public Procurement Act. The contracting authority accepts the simple declaration of the economic operator concerned in Part IV of the ESPD (i.e. filling in point α of Part IV of the ESPD) for preliminary proof. According to Section 3 (3) of Government Decree 321/2015 (X.30.), in the case of a joint tender, each joint tenderer submits a separate form. If the tenderer wishes to meet the prescribed suitability requirements by relying on the capacities of another organization or person, according to Section 67 (3) of the Public Procurement Act, the single European document must also be submitted in the tender by the organization providing the capacity in accordance with Section 3 (3) of Government Decree 321/2015 (X.30.), and when prescribing the submission of proofs, this organization or person must prove compliance with the given suitability condition in the same way as the prescribed methods of proof – exclusively with regard to the suitability requirements. According to Section 69 (4)-(7) of the Public Procurement Act, the tenderer called upon to submit the proofs must prove compliance with the requirements as follows: A statement on the turnover – calculated without VAT – derived from the subject of the public procurement in the three financial years preceding the publication of the call for tenders, closed with a balance sheet date – contained in the single European procurement document, depending on when the tenderer was established or started its activity, if these data are available - Section 19 (1) c) of Government Decree 321/2015 (X. 30.).
Description
The tenderer is suitable if it has a reference, performed in accordance with the regulations, in the 36 months preceding the date of publication of the call for tenders, which included, for Part 1: delivery of at least 10 m2 of indoor LED panels. Applicable to all parts: Suitability can also be proven by presenting several references. In the case of tendering for several parts, the reference requirement applicable to each part must be proven. A single reference can be presented for several parts if it is suitable for proving the reference requirements prescribed in the given parts. If the tenderer performed the reference in a consortium, the reference certificate must clearly show which parts of the reference the tenderer performed. The contracting authority will only take into account the part/proportion of the reference work performed by the tenderer when examining compliance with the suitability requirement. Therefore, when presenting the deliveries, please indicate the extent of your own performance in the technical quantitative content necessary for assessing suitability. If an organization wishes to present a previous activity as a reference that it performed as a member of a project company, it must prove compliance with the suitability condition by taking into account Section 140 (9) of the Public Procurement Act. If the tenderer wishes to prove its technical or professional suitability in the public procurement procedure with the references of its legal predecessor, it must also attach to its tender the documents proving the transformation, its legal succession, and the continuation of the activity. The attached statement(s) or certificate(s) must clearly show the prescribed minimum suitability requirements!

According to Section 65 (4) of the Public Procurement Act and Section 21 (1) a) of Government Decree 321/2015 (X. 30.), a description of the most significant completed deliveries in the preceding 3 years (36 months) calculated backwards from the date of publication of the call for tenders, performed in accordance with the contract and the regulations. According to Section 21 (1a) of Government Decree 321/2015 (X. 30.), the contracting authority draws attention to the fact that it has prescribed the proof of performance for three years (36 months), which means that the contracting authority takes into account deliveries completed during the period under review (the contracting authority means successful handover during the performance period), but started no more than six years (72 months) ago. The case of Section 21 (1) a) of Government Decree 321/2015 (X. 30.) must be proven in a public procurement procedure conducted according to Part Two of the Public Procurement Act on the basis of Section 22 (1) a)-b) of Government Decree 321/2015 (X. 30.). The certificate or statement must contain at least the following data: start and end date of performance (year/month/day), name and registered office of the other contracting party, subject and quantity of the delivery, and it must be stated whether the performance was in accordance with the regulations and the contract. If the performance was not in accordance with the contract, the reason and extent of the deviation must be described in the certificate or statement, and in the event of a breach of contract by the tenderer, the fact that the tenderer's liability for breach of contract exists. If suitability is proven by the statement of the tenderer or another organization participating in the proof of suitability, the statement must also contain whether the other contracting party disputes the conformity of the performance with the contract or – if the tenderer has stated this – the circumstance that the economic operator's liability for breach of contract does not exist. The contracting authority draws attention to the provisions of Section 21/A and Section 24 (1) of Government Decree 321/2015 (X.30.).
