Dublin City Council gives notice to invoke Article 32(2) (b) for a derogation from public procurement. Article 32 (2)(b) of directive 2014/24/EU which states that the negotiated procedure without prior publication may be used where the works, supplies, or services can only be supplied by a particular economic operator for (iii) the protection of exclusive rights, including intellectual property rights. Dublin City Council intends to award a contract to The Book Nest Company for a period of one year at an estimated value of €50,000. The acquisition of audiobooks and large print titles is an integral part of resources provision for Dublin City Libraries to ensure a diverse and accessible range of on-shelf stock for library users. Audiobooks and large print titles are not part of the LGMA public tender for library stock supply, as the goods are not available from mainstream suppliers and require specialist supply. Two specialist suppliers, WF Howes Ltd., Rearsby, Leicestershire, LE7 4YH United Kingdom, and Ulverscroft Ltd., Anstey, Leicester, LE7 7FU United Kingdom have exclusive rights to certain imprints required by Dublin City Libraries. Both companies have designated The Book Nest Library Supply, Co. Sligo as the sole supplier in Ireland for their unique content.
