Documentation Requirement

A declaration of net turnover (excluding VAT) from the subject of the public procurement for the three financial years closed with the balance sheet date preceding the dispatch of the tender notice, depending on when the tenderer was established or started its activity, if these data are available. The contracting authority draws attention to the fact that if the tenderer does not have the above document because it operates in a legal form in which it is not possible to submit a declaration of turnover, it may prove its financial and economic suitability with any other declaration or document deemed appropriate by the contracting authority instead of the suitability requirement and method of proof prescribed in connection with these points. The tenderer concerned is obliged to substantiate during the request for additional information that it operates in a legal form in which it is not possible to submit a declaration of turnover and to request information on the method of proving suitability accepted by the contracting authority instead of the suitability requirement and method of proof prescribed in connection with these points, in accordance with Section 19 (3) of Government Decree 321/2015. (X. 30.). Tenderers may also meet the prescribed suitability requirement through capacity-providing organizations in accordance with Section 65 (7)-(8), (11) of the Public Procurement Act. The contracting authority has set the requirement more strictly than the official list of qualified tenderers. Inclusion in the list does not prove compliance with the suitability requirements, it is stricter than that, given the prescribed turnover.

Description

The tenderer is unsuitable if it does not have a reference for live security guard services that have been continuously performed for at least six months in the three years preceding the dispatch of the tender notice, totaling at least 39,000 service hours. Services completed during the period under review, but started no more than six years ago, may be taken into account. The suitability requirement can be proven with a maximum of three references.

Documentation Requirement

Based on Section 114 (1) of the Public Procurement Act, the economic operator (Tenderer) is only obliged to declare in advance in the declaration according to Section 67 (1) of the Public Procurement Act that the suitability requirements it wishes to prove are met, and is not obliged to provide detailed data on the fulfillment of the suitability requirements. The economic operator is obliged to submit its own declarations containing detailed data on the fulfillment of the suitability requirements, and - where applicable - the objective criteria according to Section 82 (5), in accordance with the rules for submitting the certificates prescribed in the tender notice, at the request of the contracting authority according to Section 69. Section 65 (11) and Section 69 (11) of the Public Procurement Act are also applicable to the proof of suitability. In connection with the proof of the minimum suitability requirements, the contracting authority draws attention to the provisions of Section 65 (7) and Section 67 (3)-(4) of the Public Procurement Act. Based on Section 21 (3) a) of Government Decree 321/2015. (X. 30.), a description of the most significant references from the subject of the public procurement in the 3 years preceding the dispatch of the tender notice, which must include the following: • the time/duration of performance (start and end date, year/month/day), • the name and contact details of the other contracting party, • a description of the service, • a declaration that the performance was in accordance with the regulations and the contract. If the performance was not in accordance with the contract, the reason and extent of the deviation must be described in the certificate or declaration, and in the event of a breach of contract by the economic operator, the fact that the economic operator is liable for the breach of contract. If suitability is proven by a declaration of the tenderer, the participant or another organization participating in the proof of suitability, the declaration must also state whether the other contracting party disputes the conformity of the performance or - if the economic operator has declared this - the circumstance that the economic operator is not liable for the breach of contract. The reference presentation must be accompanied by a reference certificate or declaration according to Section 22 (1) of Government Decree 321/2015. (X. 30.). The reference certificate or declaration must contain all the data prescribed in the reference presentation, and it must also be declared whether the performance was in accordance with the regulations and the contract. In accordance with Section 22 (5) of Government Decree 321/2015. (X. 30.), if a reference certificate or declaration for a service ordered by the winning joint tenderer cannot be issued with the separation of the services performed by the individual tenderers due to the indivisibility of the performance, the contracting authority is obliged to accept the reference certificate or declaration from any tenderer participating in the performance in proportion to the consideration received by the tenderer submitting the certificate based on the performance performed by it. The contracting authority, in accordance with Section 21 (3a) a) of Government Decree 321/2015. (X. 30.), takes into account service orders completed during the period under review, but started no more than 6 years ago. The contracting authority draws attention to the provisions of Section 21/A of Government Decree 321/2015 (X.30.). The contracting authority has set the requirement more strictly than the official list of qualified tenderers. Inclusion in the list does not prove compliance with the suitability requirements, it is stricter than that, given the requirement in the reference.

Description

The tenderer is unsuitable if it does not have: a) at least 1 security manager with a higher education degree, a certificate entitling to perform personal and property guard activities as stipulated in Act CXXXIII of 2005, and at least 24 months of security or security organization management experience, as well as a language exam certificate proving at least basic (B1 level) English verbal communication skills according to the CEFR or an equivalent certificate. CEFR is the Common European Framework of Reference for Languages. b) at least 3 personal and property guards with at least a secondary education degree, a certificate entitling to perform personal and property guard activities as stipulated in Act CXXXIII of 2005, and a language exam certificate proving at least basic (B1 level) English verbal communication skills according to the CEFR or an equivalent certificate. Overlap between the experts to be presented under M.2) a) and b) is not allowed. The contracting authority applies the restriction according to Section 65 (10) of the Public Procurement Act in connection with the M.2. a) security manager, given that this is a particularly important task for the performance of the contract. The capacity of another organization cannot be used to prove the suitability conditions for these tasks according to Section 65 (9) of the Public Procurement Act.

Documentation Requirement

The names of the required experts, a copy of the document proving their qualifications, education, and the required language skills, and the declarations of availability of the experts. The tenderer is obliged to submit documents proving the English verbal communication skills of the experts. The provisions of Government Decree 137/2008. (V. 16.) on state-recognized language examinations proving foreign language proficiency and on the naturalization of foreign language examination certificates issued abroad in Hungary (hereinafter: Government Decree 137/2008. (V. 16.)) are applicable. The proof of equivalence is the responsibility of the tenderer(s), in this regard the contracting authority draws attention to the provisions of Section 14 of Government Decree 137/2008. (V. 16.). The following documents are particularly acceptable for proving the requirement: a) a language exam certificate or partial certificate proving at least B1 level English language proficiency according to the Common European Framework of Reference (CEFR), provided that it proves at least listening comprehension and speaking skills; b) an international language exam, certificate or other document on the basis of which the expert's English listening comprehension and speaking skills at least at B1 level can be clearly established. The proof of acceptability and equivalence of a document equivalent to the language exam certificate according to point a) is the responsibility of the tenderer. In the case of an expert involved in the M2)a) suitability condition, a professional CV signed by the expert must also be attached, detailing the expert's professional experience. According to Section 114 (2) of the Public Procurement Act, the economic operator is only obliged to declare in the tender that the suitability requirements it wishes to prove are met, and the submission of certificates takes place according to Section 69 (4) of the Public Procurement Act. Based on Section 21 (3) b) of Government Decree 321/2015. (X. 30.), the names of the experts to be involved in the performance, a copy of the document proving their qualifications, education, and the declarations of availability of the experts. The contracting authority has set the requirement more strictly than the official list of qualified tenderers. Inclusion in the list does not prove compliance with the suitability requirements, it is stricter than that, given the prescribed education, qualifications and experience of the experts.
