A MÁV Személyszállítási Zártkörűen Működő Részvénytársaság alkatrészeket szerez be vonatbefolyásoló berendezésekhez, kiegészítő pneumatikus és elektronikai alkatrészekhez egy 24 hónapos keretszerződés keretében, Budapesten. A beszerzés célja a tétellistában meghatározott, vagy azzal egyenértékű termékek szállítása és átadása a megrendelő részére. Az elbírálás kizárólag a nettó ajánlati összérték (HUF) alapján történik. A pályázóknak igazolniuk kell, hogy az előző három lezárt üzleti évben összesen legalább nettó 131.000.000,- Ft árbevétellel rendelkeztek, valamint be kell mutatniuk az eljárást megindító felhívás feladásától visszafelé számított hat évben (72 hónapban) teljesített, "vonatbefolyásoló berendezés és/vagy alkatrészek" szállítására vonatkozó referenciákat.

Eljárás megnevezése: Ajánlatkérő a Kbt. Második rész XV. fejezete szerinti nyílt közbeszerzési eljárást kíván lefolytatni – figyelemmel a közszolgáltatók közbeszerzéseire vonatkozó sajátos közbeszerzési szabályokról szóló 307/2015. Ajánlatkérő mindhárom rész tekintetében a tétellistában meghatározott gyártmányú vagy azzal egyenértékű terméket kíván beszerezni. A közbeszerzési eljárás eredményeként megkötendő szerződés alapján – adott rész tekintetében – nyertes Ajánlattevő feladata a Tétellistában rögzített termékeknek – a Szerződés és mellékletei szerinti dokumentumokkal együtt – a meghatározott teljesítési hely(ek)re történő szállítása és átadása az Ajánlatkérő részére, az Ajánlatkérő megrendeléseinek megfelelően, a Szerződésben foglaltak szerint. Ajánlatkérő felhívja érdeklődő gazdasági szereplők figyelmét, hogy jelen eljárást megelőző, EKR000993922025 számú, nyilvános előzetes piaci konzultáció során kiadott dokumentumok nem egyeznek meg teljes mértékben azzal, amelyekre jelen eljárás során hivatkozik Ajánlatkérő. Gazdasági szereplő kizárólagos felelőssége, hogy az ajánlattételi határidőig beszerezzen minden olyan dokumentumot, információt, amely az ajánlat megfelelő elkészítéséhez szükséges.

Description
The tenderer is eligible if their total turnover – calculated without VAT – in the previous three closed financial years reaches a total of HUF 131,000,000, i.e. one hundred thirty-one million forints. For clarity, the Contracting Authority wishes to state that if a tenderer wishes to submit a bid for several parts, in order to be considered eligible for all parts bid for, the highest of the minimum requirements applicable to the parts bid for must be met as a minimum requirement. The tenderer only needs to declare the turnover for the business year/years from the previous three closed financial years with which they can prove compliance with the minimum requirement. According to Section 19 (3) of Government Decree 321/2015 (X.30.), if the tenderer does not have the above data because they operate in a legal form for which it is not possible to make a statement on turnover, they may prove their financial and economic eligibility with any other statement or document deemed appropriate by the Contracting Authority instead of the prescribed eligibility requirement and method of proof. The tenderer concerned must substantiate during the request for additional information that they operate in a legal form for which it is not possible to submit a statement on turnover and request information on the method of proving eligibility accepted by the Contracting Authority instead of the eligibility requirement and method of proof prescribed in connection with these points.
Documentation Requirement
The method of proof: The provisions of Section 1 (1) of Government Decree 321/2015 (X.30.) shall apply mutatis mutandis to the proof of eligibility. The tenderer must declare in their bid in advance, based on Section 67 (1) of the Public Procurement Act, in accordance with Chapter II of Government Decree 321/2015 (X. 30.), based on Section 19 (1) c) of Government Decree 321/2015 (X. 30.), their total turnover – calculated without VAT – for the previous three closed financial years, depending on when the tenderer was established or started its activity. Sections 65 (6)-(8) and (11) of the Public Procurement Act shall apply mutatis mutandis to the proof of the eligibility requirement. Based on Section 5 (1) of Government Decree 321/2015 (X.30.), the Contracting Authority draws the attention of economic operators to the fact that they must fill in Part IV of the ESPD form taking into account the following. Based on Section 2 (5) of Government Decree 321/2015 (X.30.), the Contracting Authority requests the detailed information contained in Part IV of the ESPD form, and also draws the attention of economic operators to the fact that the required eligibility requirement(s) must be precisely indicated in the form when filling it in. The information requested to be provided in the ESPD during the preliminary proof of the eligibility requirement for each eligibility requirement is contained in point I. 11 of the Procurement Documents.

The method of proving the reference: The provisions of Section 1 (1) of Government Decree 321/2015 (X.30.) shall apply mutatis mutandis to the proof of eligibility. The tenderer must prove in advance in their bid, in accordance with Chapter II of Government Decree 321/2015 (X.30.), by submitting the ESPD, that they meet the eligibility requirements. The Contracting Authority provides the ESPD as part of the Procurement Documents in electronic form. Based on Section 5 (1) of Government Decree 321/2015 (X.30.), the Contracting Authority draws the attention of economic operators to the fact that they must fill in Part IV of the ESPD form taking into account the following. Based on Section 2 (5) of Government Decree 321/2015 (X.30.), the detailed information contained in Part IV of the ESPD form, as well as the required eligibility requirements, must be precisely indicated in the form. The information requested to be provided in the ESPD during the preliminary proof of the eligibility requirements for each eligibility requirement is contained in point I.11 of the Procurement Documents. The Contracting Authority will only take into account the statement contained in the ESPD for the fulfillment of the preliminary proof obligation during the evaluation phase of the procedure. The Contracting Authority will disregard the proofs submitted by the economic operator in their bid without the Contracting Authority's request according to Section 69 (4)-(6) of the Public Procurement Act, and will only include them in the evaluation before the decision closing the procedure, only for those tenderer(s) whom the Contracting Authority wished to request the submission of the proofs. If the tenderer has submitted the proofs earlier, the Contracting Authority will not request the tenderer to submit the proofs again, but will consider them as if the previously submitted proofs were submitted at the request of the Contracting Authority – and will order a request for clarification or additional information if necessary. The proofs relating to the eligibility requirements must be submitted at the specific request of the Contracting Authority, based on Section 69 (4)-(6) of the Public Procurement Act, as follows. Based on Section 21 (1) a) of Government Decree 321/2015 (X.30.), a description of deliveries of "train control equipment and/or parts" completed in the six years (72 months) preceding the dispatch of the call for tenders, proven in the form according to Section 22 (1)-(2) of Government Decree 321/2015 (X.30.), with at least the following content: - name of the other contracting party; - name and contact details of the contact person (address and/or telephone number and/or e-mail and/or fax); - description of the subject of the delivery (in such detail that compliance with the prescribed eligibility condition can be clearly established); - start date of the reference performance (year, month, day accuracy); - end date of the reference performance (year, month, day accuracy); - net consideration received for the completed delivery (value of own performance in the period under review); - the performance was in accordance with the specifications and the contract. - if the performance was not in accordance with the contract, the reason and extent of the deviation must be described in the proof or statement, and in the event of a breach of contract by the economic operator, whether the economic operator's liability for breach of contract exists. If the eligibility is proven by a statement from the tenderer or another organization participating in the proof of eligibility, the statement must also include whether the other contracting party disputes the conformity of the performance or – if the economic operator has declared this – the circumstance that the economic operator's liability for breach of contract does not exist. If compliance with the given eligibility requirement can be proven by performance for an organization according to Section 5 (1) a)-c) and e) and f) of the Public Procurement Act based on Section 22 (1) a) of Government Decree 321/2015 (X.30.) (or in the case of non-Hungarian organizations, an organization that qualifies as a contracting authority under Directive 2014/24/EU of the European Parliament and of the Council), the eligibility must be proven by submitting a reference certificate issued or signed by the organization. If compliance with the given eligibility requirement can also be proven by a reference statement according to Section 22 (2) of Government Decree 321/2015 (X.30.), the Contracting Authority will not request the reference statement(s) made in the ESPD again in its request according to Section 69 (4)-(6) of the Public Procurement Act. The presented references must relate to deliveries performed in accordance with the contract, or to deliveries where a breach of contract occurred, but the economic operator's liability for breach of contract – undisputed by the other contracting party – does not exist. The Contracting Authority will only take into account deliveries completed (finished) during the period under review (six years preceding the dispatch of the call for tenders), but started no earlier than nine years before the dispatch of the call for tenders, when proving compliance with the eligibility requirement. Consequently, for the presented references (both during the preliminary proof according to the ESPD and – if the submission of a reference certificate is required – during the subsequent proof according to Section 69 (4) of the Public Procurement Act), it must be clear what proportion of the references were completed in the period examined by the Contracting Authority – i.e. in the six years (72 months) preceding the dispatch of the call for tenders! Deliveries whose completion ended earlier than the period under review cannot be taken into account when proving compliance with the eligibility requirement. The Contracting Authority must accept proof that the result or activity contained in the reference requirement was realized as a partial performance of the contract.
