A Digitális Kormányzati Ügynökség Zártkörűen Működő Részvénytársaság mobil távközlési szolgáltatásokat kíván beszerezni egy 42 hónapos keretmegállapodás keretében, amely magában foglalja a mobil kommunikációs szolgáltatást, a telemetria (IoT) szolgáltatást és a tömeges SMS szolgáltatást 11 féle szolgáltatási csomagban, VoWiFi, HD hang és VoLTE szolgáltatások biztosításával. A Magyar Telekom Távközlési Nyilvánosan Működő Részvénytársaság, a Vodafone Magyarország Távközlési Zártkörűen Működő Részvénytársaság és a Yettel Magyarország Zártkörűen Működő Részvénytársaság rendelkezik hasonló szerződéssel. Az ajánlatokat a korrigált érték (100%) alapján bírálják el.

Description
The contracting authority does not prescribe a qualification requirement for technical and professional ability in the public procurement procedure (Section 65 (2) of the Public Procurement Act) due to the following: Both domestically and in Europe, the mobile telecommunications sector is characterized by three-four economic operators competing with each other in the mobile telecommunications markets of the member states, making the mobile telecommunications market extremely concentrated and saturated compared to other markets. At a European level, approximately three-four economic operators provide mobile telecommunications services, with these providers present in EU member states in the form of subsidiaries, joint ventures, or commercial agreements. The procurement need can only be met by these three-four economic operators, whether viewed from a domestic or European perspective, which is supported by market research conducted by the Contracting Authority and an analysis of the results of public procurement procedures initiated on the same subject in recent years. For the small number of market players, there is no quantitative (measurable) parameter that would be worth prescribing in accordance with the public procurement rules related to qualification requirements, such as subscriber numbers or expert requirements, given that all potential market players capable of submitting a valid bid would meet these parameters, thus practically emptying the function of the qualification requirement and imposing an unjustified and unnecessary administrative burden on the participants in the public procurement procedure. In addition to the concentration of the sector, the market is characterized by strict and continuous supervision by the National Media and Infocommunications Authority (NMHH). The operation of service providers, network compliance, and financial stability are continuously monitored by law and by authorities, meaning that the operation of market players is guaranteed at a state level, i.e., all economic operators potentially capable of bidding in the procedure, without exception, possess the human resources, subscriber base, and financial stability necessary for performance. Prescribing any measurable (quantitative or qualitative) qualification requirement – including, in particular, minimum requirements for experts or previous references – would empty the real, filtering function of the qualification condition. The Contracting Authority ensures the security of performance and the expected quality of the service not through qualification conditions based on past data, but through the objective technical description recorded in the public procurement document and the establishment of a contractual sanction system.
