Description
A tenderer shall be deemed ineligible if they do not hold a certificate, valid at the time of the tender submission deadline, demonstrating the operation of an ISO 27001 (or equivalent) information security management system for the subject to the procurement, issued either by any nationally accredited system or by an organisation registered in another Member State of the European Union, or if they cannot provide other evidence in accordance with Section 24(4) of Government Decree 321/2015 (X.30.).
Documentation Requirement
With regard to the suitability/eligibility criteria, the tenderer is only required to submit, in its tender, the declaration included in the Single European Procurement Document (SEPD). The Contracting Authority accepts a simple declaration pursuant to Section IV, point (α) of the SEPD for the preliminary demonstration of the suitability/eligibility criteria. Upon the Contracting Authority’s request pursuant to Section 69 of the Public Procurement Act, the tenderer is required to submit, in accordance with Section 21 (1) (c) of Government Decree 321/2015 (X.30.), either a copy of a certificate demonstrating the operation of an information security management system accredited in any national system, or a description of the information security measures that the tenderer is able to implement during performance.
