Description

All economic operators who express interest will be asked to submit a completed ESPD as part of confirming their continuing interest in the procurement process. The ESPD constitutes preliminary evidence that the tenderer is not subject to a ground for exclusion and meets the requirements of the contracting entity as to the tenderer's economic and financial standing/capacity. The instructions for completion and submitting an ESPD will be stated to all economic operators who express their interest in the procurement process. Compulsory grounds for exclusion: In Part III of the ESPD, the economic operator must declare not to be covered by the mandatory exclusion grounds set out in section 135(1) and (3) and section 136 of the Public Procurement Act. Non-compulsory grounds for exclusion - section 137(2) of the Public Procurement Act: The economic operator will also be excluded from participation in the tender procedure if: 1) the economic operator is bankrupt or is the subject of insolvency or winding-up proceedings, where its assets are being administered by a liquidator or by the court, where it is in an arrangement with creditors, where its business activities are suspended or it is in any analogous situation arising from a similar procedure under national laws and regulations. The economic operator shall indicate this in the ESPD. However, if the economic operator is subject to one or more of the grounds for exclusion but has provided sufficient evidence that the economic operator is nevertheless reliable, in accordance with Section 138 of the Public Procurement Act, the economic operator may still be taken into consideration. If the economic operator is made up of a group of entities (i.e. where several companies submit a joint application as a consortium and intend to submit a tender as a consortium), each of the companies in the consortium must complete and submit an individual ESPD. Upon request from the contracting entity, the group of entities must submit documentation (a declaration of joint representation for consortia).

If the economic operator relies on the economic and financial standing or the technical and professional ability of other entities, the economic operator must, upon the contracting entity’s request, present support declarations or other documentation verifying that the economic operator does in fact have the required economic and financial standing and/or the technical and professional ability at their disposal. The economic operator's confirmation of continuing interest must include a completed ESPD for both the economic operator and a separate, completed ESPD (with relevant information) for each of the entities on which the economic operator relies.
