A BKM Budapesti Közművek Nonprofit Zártkörűen Működő Részvénytársaság kertészeti kéziszerszámokat, kisgéptartozékokat és segédeszközöket szerez be a FŐKERT Kertészeti Divízió, a BTI temetkezési főigazgatóság és az FKF Köztisztasági főigazgatóság számára Budapesten, nettó 84 000 000 Ft keretösszeg erejéig, 12 hónapos időtartamra. A beszerzés 6 féle leggyakrabban előforduló termékcsoportból (várhatóan 1195 db) és 47 féle fix termékből (2231 db) áll. Az elbírálás során az ár (75%), a referenciaárból adott kedvezmény mértéke (20%) és a vállalt többletjótállás (5%) súlyozottan számít. Az ajánlattevőnek az eljárást megindító felhívás feladását megelőző 3 lezárt üzleti évben legalább 1 évben pozitív adózott eredménnyel kell rendelkeznie, vagy ha később kezdte meg működését, akkor a közbeszerzés tárgyából származó árbevételének el kell érnie a 40 000 000 Ft-ot. Továbbá, az ajánlattevőnek rendelkeznie kell az elmúlt 3 évben befejezett, legalább 420 db kertészeti kéziszerszám értékesítésére vonatkozó referenciával.

Qualification requirements
Description
The tenderer is eligible to perform the contract if its after-tax profit has been positive in at least 1 (one) year during the 3 (three) closed business years preceding the publication of the call for tenders. If the tenderer does not have the document referred to in point P/1 for the entire period required by the contracting authority because it started its operations after the beginning of the period, the contracting authority must determine the tenderer's financial and economic eligibility with regard to point P/1 if the tenderer's turnover (calculated without VAT) from the subject of the public procurement (supply/sale of horticultural hand tools) during its operation reaches or exceeds HUF 40,000,000.
Documentation Requirement
The contracting authority will check the compliance with the eligibility condition in 2 rounds: in the first round, preliminary verification based on the European Single Procurement Document (ESPD), and in the second round, the submission of certificates and declarations according to Government Decree 321/2015. (X. 30.) within the framework of the review according to Section 69 (4) of the Public Procurement Act. The tenderer and the economic operator participating in the verification of eligibility shall provisionally verify compliance with the eligibility conditions by submitting the ESPD in accordance with Section 5 (1) of Government Decree 321/2015. (X. 30.). The contracting authority, based on Section 2 (5) of Government Decree 321/2015. (X. 30.), accepts a simple declaration from the economic operator for the preliminary verification of eligibility requirements, provided that the economic operator only needs to fill in Section "α" (alpha) of Part IV of the ESPD. We draw attention to the provisions of Section 3 of Government Decree 321/2015. (X. 30.). P/1. According to Section 19 (1) b) of Government Decree 321/2015. (X. 30.), the economic operator called upon by the contracting authority to submit certificates regarding eligibility requirements in accordance with Section 69 (4)-(7) of the Public Procurement Act must submit its own or its legal predecessor's financial statements according to accounting regulations (if the law of the country where the economic operator is established requires their publication). If the financial statements requested by the contracting authority are available on the website of the company information service, the contracting authority will check the data of the financial statements, and it is not necessary to submit the financial statements found on the website of the company information service. If the tenderer does not have the document referred to in point P/1 for the entire period required by the contracting authority because it started its operations after the beginning of the period, it is entitled to prove its eligibility with a declaration of turnover from the subject of the public procurement. If the tenderer does not have the document referred to in point P/1 because it operates in a legal form for which the submission of a declaration of turnover is not possible, it may prove its financial and economic eligibility with any other declaration or document deemed appropriate by the contracting authority instead of the eligibility requirement and method of proof prescribed in connection with this point. The affected tenderer must, when requesting additional information, substantiate that it operates in a legal form for which the submission of a declaration of turnover is not possible, and request information on the method of proving eligibility accepted by the contracting authority instead of the eligibility requirement and method of proof prescribed in connection with this point.

The tenderer is eligible if it has references for the sale (delivery) of at least 420 horticultural hand tools, completed within 3 (three) years preceding the publication of the call for tenders (completed within the examined period, but started no more than six years ago), related to the subject of the public procurement. (X. 30.). The tenderer can prove compliance with the eligibility requirement by describing its most significant deliveries related to the subject of the public procurement, completed within three years preceding the publication of the call for tenders (completed within the examined period, but started no more than six years ago). The certificate must include the following: - the time of performance (start and end date with year-month-day accuracy); - the other party to the contract; - the subject of the delivery; - its quantity or the amount of consideration; - and a declaration whether the performance was in accordance with the regulations and the contract. If the performance was not in accordance with the contract, the reason and extent of the deviation must be described in the certificate or declaration, and in case of breach of contract by the economic operator, whether the economic operator's liability for breach of contract exists. If the eligibility is proven by a declaration from the tenderer, the participant, or another organization participating in the verification of eligibility, the declaration must also state whether the other party to the contract disputes the conformity of the performance or – if the economic operator has declared this – the circumstance that the economic operator's liability for breach of contract does not exist. The contracting authority is entitled to prescribe the provision of additional data necessary for determining eligibility among the content elements of the reference certificate or declaration. It must be clearly ascertainable from the certificate that the tenderer fully complies with the eligibility requirement. If a reference certificate for a delivery performed as a joint tenderer cannot be issued – due to the indivisibility of the performance – by separating the deliveries performed by the individual tenderers, the contracting authority will accept the reference certificate from the tenderer participating in the performance in proportion to the share of the consideration received by the tenderer submitting the certificate based on the performance carried out by it. In case of joint performance with another economic operator, the reference certificate must contain the above data in such a way that compliance with the minimum eligibility requirements can be clearly ascertained. If an organization wishes to present a previous activity performed as a member of a project company as a reference, it must prove compliance with the eligibility condition taking into account Section 140 (9) of the Public Procurement Act. If the tenderer wishes to prove its technical eligibility in the public procurement procedure with the references of its legal predecessor, it is necessary to attach to its tender the documents proving the transformation, legal succession, and continuation of the activity.
