Az Építési és Közlekedési Minisztérium Nyírbátor Várost elkerülő utak kivitelezését szerzi be, amely két részből áll: a 471. sz. főút Déli-keleti elkerülő út és a 493. sz. főút Nyugati elkerülő út megvalósításából Szabolcs-Szatmár-Bereg megyében, 24 hónapos időtartamra. Az ajánlatokat az ár (70%), valamint a bemutatott szakemberek többlet szakmai tapasztalata (3x10%) alapján értékelik. A részvételhez az utolsó három lezárt üzleti évben legalább 10 milliárd HUF közútépítésből származó árbevételt kell igazolni. Továbbá, a felhívás feladásától számított 8 éven belül befejezett, de legfeljebb 11 éven belül megkezdett, legalább 4,5 km hosszúságú, új nyomvonalon létesült, legalább 2x1 sávos országos közút építésére vonatkozó referenciával, és legalább 1 db, vasút felett átvezetett, új országos közúti híd építésére vonatkozó referenciával kell rendelkezni, ahol a híd szabadnyílása elérte vagy meghaladta a 20 métert.

Description
The tenderer (joint tenderer) is unsuitable if, in the last three financial years preceding the date of dispatch of the call for tenders, the turnover from the subject of the public procurement (road construction) – calculated without VAT – does not reach a total of HUF 10,000,000,000 over 3 years. For economic operators established later, the contracting authority does not specify a turnover requirement different from that applicable to all tenderers. In the case of joint participation/joint tendering, the P.1) suitability requirement may be met jointly by joint tenderers, and compliance may also be demonstrated through a capacity organisation. In the case of tendering for several parts, it is sufficient to demonstrate compliance with the higher turnover requirement. Definitions: "Public road": the concepts according to Sections 8 (1) – (2) of Government Decree 26/2021. (VI.28.) ITM on the administration of public roads, excluding those contained in Section 8 (1) cd) and Section (2) c) and d) of Government Decree 26/2021. (VI.28.) ITM. "Construction": the work according to Section 5 78. of Government Decree 12/2025. (V.8.) ÉKM on the construction of public roads.
Documentation Requirement
The tenderer's declaration of turnover from the subject of the public procurement (road construction) – calculated without VAT – in the last three financial years preceding the date of dispatch of the call for tenders, depending on when the tenderer was established or started its activity, if these data are available. If the tenderer does not have the document according to point P.1) because it operates in a legal form for which the submission of a declaration of turnover is not possible, it may prove its financial and economic suitability with any other declaration or document deemed appropriate by the contracting authority instead of the suitability requirement and method of proof prescribed in connection with this point. The affected tenderer must substantiate during the request for additional information that it operates in a legal form for which the submission of a declaration of turnover is not possible and request information on the method of proving suitability accepted by the contracting authority instead of the suitability requirement and method of proof prescribed in connection with this point. If the tenderer cannot provide the turnover data according to point P.1) for the entire period prescribed by the contracting authority because it started its operation after the beginning of the period, it is entitled to prove its suitability with the turnover data for the period after the start of its operation.

The tenderer (joint tenderer) is unsuitable if it does not have, in the 8 years (96 months) preceding the date of dispatch of the call for tenders, but started no more than 11 years (132 months) ago, successfully completed, technically accepted references for: - at least 4.5 km long, newly built, at least 2x1 lane national road construction, and - at least 1 new national road bridge construction over a railway, where the clear span of the bridge (in the case of a bridge with multiple clear spans, its largest clear span) reached or exceeded 20 meters. Both reference requirements can be proven with 1-1 contract/performance, with the proviso that the same contract/performance can be presented to prove compliance with both reference requirements. In the case of tendering for several parts, the same reference can be presented in several parts. The contracting authority accepts the proof of completed performances where, although a breach of contract occurred, the economic operator's liability for the breach of contract – undisputed by the other contracting party – does not exist. In the case of joint participation/joint tendering, the M.1) suitability requirement may be met jointly by joint tenderers, and compliance may also be demonstrated through a capacity organisation. Definitions for the M.1) suitability requirement(s): "National road": the concept according to Section 8 (1) of Government Decree 26/2021. (VI. 28.) ITM, excluding those contained in Section 8 (1) c) of the decree. "Construction": the work according to Section 5 78. of Government Decree 12/2025. (V.8.) ÉKM on the construction of public roads. "Road bridge": the concept according to Section 5 40. of Government Decree 12/2025. (V.8.) ÉKM on the construction of public roads, serving the passage of the national road. "Clear span of the bridge": the distance between adjacent rising structures (abutments, piers), understood in the axis of the bridge superstructure and in the upper plane of the structural beams. In relation to the above definitions, the contracting authority ensures equivalence in terms of compliance with domestic legal regulations. In the scope of the minimum requirements set out in the sub-points of requirement M.1), the contracting authority accepts if not all elements of the definition prescribed by the contracting authority – excluding concepts defined by law – appear in the attached certificate, but compliance with the concept can be determined based on the content of the reference. Proving equivalence is the tenderer's task and responsibility.
Documentation Requirement
Description of the most significant construction investments completed in the 8 years (96 months) preceding the date of dispatch of the call for tenders, but started no more than 11 years (132 months) ago, with a certificate issued by the other contracting party. The certificate must include at least: - the name and registered office (address) of the other contracting party; - the name and telephone number or e-mail address of the person providing information about the reference; - the subject and quantity of the reference, a detailed description of the technical content implemented by the economic operator, from which compliance with the suitability requirement can be determined; - the start date of the performance (year/month/day accuracy); - the date of completion of the technical acceptance (year/month/day accuracy); - the place of performance; - the statement of the issuer of the certificate as to whether the performance was carried out in accordance with the specifications and the contract. If the performance was not in accordance with the contract, the reason and extent of the deviation must be described, and in the event of a breach of contract by the economic operator, the fact that the economic operator's liability for the breach of contract exists. In the case of joint tenderer performance, the reference certificate must clearly show the work performed by the tenderer and the percentage of its own performance. The contracting authority will only take into account the work performed by the tenderer during the evaluation. In the case of indivisibility of performance, the data according to Section 22 (5) of the Government Decree must be provided. If an organisation wishes to present a previous activity as a reference that it performed as a member of a project company, it must prove compliance according to Section 140 (9) of the Public Procurement Act. If the tenderer wishes to prove its suitability in the procedure with the references of its legal predecessor, it must also attach to its tender the documents proving the transformation, its legal succession, and the continuation of the activity. A reference is considered completed if the successful (partial) technical acceptance of the investment forming its subject took place in the 8 years (96 months) preceding the date of dispatch of the call for tenders. The contracting authority draws attention to Section 21/A of the Government Decree in this regard.
Description
Description of the experts – especially those responsible for quality control – with their qualifications, education, and professional experience, whom the tenderer intends to involve in the performance. The contracting authority will take into account the professional experience presented in both suitability and evaluation from the acquisition of the qualification or education required for the authorisation. If any expert does not yet have the chamber registration at the time of tendering, the tenderer's declaration must be submitted that the expert will have it by the time of concluding the contract at the latest. Failure to register is considered a withdrawal from the contract by the tenderer, in which case the contracting authority will proceed according to Section 131 (4) of the Public Procurement Act.
Documentation Requirement
Declaration of presented experts (EKR form), self-signed CV of experts, declaration of availability, document proving qualification or education. The contracting authority stipulates, based on Section 69 (7) of the Public Procurement Act, that if an additional offer is made in the scope of the evaluation, the CV and the school diploma proving the prescribed or equivalent authorisation, or the education and qualification required by law for its acquisition, must be submitted as part of the first offer – not burdened by the obligation to offer. Proving the equivalence of the qualification or education is the tenderer's obligation and responsibility (when proving the equivalence of qualifications acquired abroad, taking into account the provisions of Act C of 2001 on the recognition of foreign certificates and diplomas). The contracting authority also accepts authorisations equivalent to those prescribed. In the CV, professional experience must be described with year/month detail. The contracting authority will only take into account overlapping periods once. In the scope of the suitability requirement, all elements of the definition prescribed by the contracting authority – excluding concepts defined by law – must be described as a phrase according to the suitability requirement in the expert's CV. The contracting authority accepts if not all phrases are described, but it is referred to in the CV that the content of the job/position/task/work presented in the offer is identical to the definition given in the call for participation. If the expert already has chamber registration at the time of tendering, the qualification or education and professional experience required for the authorisation do not need to be proven separately, it is proven by the valid authorisation, it is sufficient to provide the expert's registration number and the electronic access path required for its verification and the first date of acquisition of the authorisation in the CV.
