For economic operators not established in Hungary, the economic operator must be registered in the register of the country of establishment, or possess the license, authorization, or organizational/chamber membership required in the country of establishment.
Documentation Requirement
The economic operator must initially prove compliance with the eligibility condition by submitting the ESPD in their bid, according to Kbt. 67. § (1)-(3) and Kr. 1. § (1). The contracting authority accepts a simple declaration from the economic operator without providing detailed information in Part IV of the form, meaning it is sufficient to fill in Part IV α. (alpha) of the ESPD. For joint economic operators, the declaration is made by the economic operator submitting the bid. Economic operators called upon to submit certifications according to Kbt. 69. § (4) must prove compliance with the eligibility requirements as follows: The contracting authority verifies registration in the registers according to Kbt. 69. § (11). The relevant national professional chamber according to 322/2015. (X.30.) Korm. Decree 8. § (1) is the Hungarian Chamber of Engineers (MMK) in accordance with 266/2013. (VII.11.) Korm. Decree 5. §, requiring registration in the relevant chamber register for economic operators established in Hungary. For economic operators not established in Hungary, proof of registration in the register of the country of establishment, or proof of possessing the license, authorization, or organizational/chamber membership required in the country of establishment, must be submitted upon the contracting authority's request according to Kbt. 69. §. If free verification of the relevant data and facts in the registers according to Kbt. 69. § (11) is not possible, proof must be submitted by providing a simple copy of the register extract, a certificate issued by the body maintaining the register, or a document proving registration. The capacity of another organization may be used to prove the requirements of Kbt. 65. § (1) c) (SZ/1) if it performs the task for which the obligation of registration, organizational membership, or possession of a license exists. The commitment must support this. The contracting authority draws attention to the provisions of Kbt. 65. § (6)-(7), (9), (11) and 69. § (11)-(11a), and Kr. 26. § (3), and Directive 2014/24/EU Annex XI ("Registers").
Description
The economic operator, or joint economic operators, must have a net turnover of at least 2,500 million HUF (excluding VAT) from railway construction in the last three closed business years preceding the publication of the call for tenders. "Railway construction" includes the construction of railway tracks and/or railway overhead lines and/or railway area lighting and/or signaling equipment and/or railway telecommunication facilities, where "construction" includes new construction and/or reconstruction and/or conversion and/or modernization and/or development and/or renovation.
Documentation Requirement
The economic operator must initially prove compliance with the eligibility condition by submitting the ESPD in their bid, according to Kbt. 67. § (1)-(3), Kr. 1. § (1), and 2. § (5). The contracting authority accepts a simple declaration from the economic operator without providing detailed information in Part IV of the form, meaning it is sufficient to fill in Part IV α. (alpha) of the ESPD. Based on Kbt. 69. § (4)-(7), the economic operator called upon to submit certifications must prove compliance with the eligibility requirements as follows: The economic operator must attach a simple declaration of their net turnover (excluding VAT) from the subject of the public procurement (railway construction) for the last three closed business years preceding the publication of the call for tenders, according to Kr. 19. § (1) c), depending on when the economic operator was established or started its operations, if this data is available. If the economic operator started its operations later (and therefore does not have turnover data for the subject of the public procurement in the previous three closed business years), the total net turnover from the subject of the public procurement for the business years since the start of its operations must reach the required amount. If the economic operator's declaration shows fewer than three closed business years, but compliance with the eligibility requirement can be determined from it, the contracting authority will not request additional documentation for the missing business year(s). The contracting authority notes that the date of publication of the announcement on TED is considered the date of publication of the call for tenders. The contracting authority draws attention to the provisions of Kr. 19. § (3) regarding the proof of eligibility. Kbt. 65. § (6)–(8), (11)-(12) and Kr. 19. § (7) apply accordingly. According to Kbt. 65. § (6), joint economic operators may collectively meet the requirement specified in P1/. by summing their turnovers. It is sufficient for one of the joint economic operators to meet the eligibility requirement under P1/., so it is sufficient for only one to attach the certification under P1/.

69. § (4)-(7), compliance with the eligibility requirements must be proven as follows: According to Kr. 21. § (2) b), the names, qualifications, and professional experience of the experts (organizations) – especially those responsible for quality control – to be involved in the performance must be described. The following must be attached when presenting the experts: - Declaration from the economic operator regarding the names, dates of birth of the experts to be involved in the performance, the organization (person) with whom the expert has a legal relationship, specifying the legal relationship, and for which eligibility requirement they are to be presented (EKR form); - Professional CV proving professional experience, signed by the expert (from which the expert's experience required in the minimum requirement is clearly evident, with year/month detail, indicating the expert's employer or the person/entity with whom the expert has another employment relationship); - Simple copies of documents proving the experts' qualifications (degree or training); - Declaration of availability signed by the experts. If the expert presented for M2/2. and 3. points is registered in the chamber register proving the right to practice the profession, the valid authorization also proves the qualification and practice necessary for obtaining the authorization for M2/2. and 3. experts. In this case, the expert's professional CV must be attached with content that allows the contracting authority to verify the existence of the authorization (providing member ID, electronic access path, first date of obtaining authorization). Submission of other documents proving qualification (degree or training) is not necessary. The contracting authority verifies the electronic register. If the expert has a valid authorization, but is not registered in the registers according to Kbt. 69. § (11) or free verification of the authorization is not possible, the document(s) proving the valid authorization must be submitted in simple copy. In this case, submission of other documents proving qualification (degree or professional qualification) is not necessary. The contracting authority draws attention to the fact that for M2/1. expert, the required professional experience must be specifically described in the professional CV. The contracting authority verifies the existence of practical experience based on the CV. Overlapping practical periods are counted only once towards the practical experience of the given expert. The duration of professional experience is calculated from the date of obtaining the qualification (degree or training) required for the expert, for which reason the date of obtaining the qualification must also be indicated in the CV. Proving equivalence is the obligation and responsibility of the economic operator. Overlap between experts is not allowed. Based on Kbt. 69. § (7), the contracting authority draws attention to the fact that since evaluation criteria are attached to M2/ 1., 2., and 3. eligibility conditions, proof of these eligibility conditions must be submitted together with the bid if the economic operator presents additional or special professional experience in relation to the 1.-3. quality evaluation criteria. For M1/-M2/ eligibility requirements, Kbt. 65. § (6)-(7), (9), (11)-(12) and Kbt. 69. § (11), (11a), Kr. 1. § (3)-(3a), (7) also apply.
