A Budapest Gyógyfürdői és Hévizei Zrt. építési munkálatokat igényel a Széchenyi Gyógyfürdő és Uszoda női termál részlegének felújítására Budapesten, az Állatkerti körút 9-11. szám alatt. A szerződés 12 hónapra szól, és magában foglalja a medenceterek padozatának részleges bontását, gépészeti és épületvillamossági rendszerek átalakítását, tartószerkezeti megerősítést, valamint műemléki elemek restaurálását. Az ajánlatokat az összesített ajánlati ár (70%) és a minőség (30%) alapján bírálják el. A minőségi kritériumok között szerepel a szakemberek többlettapasztalata műemlék épület felújításában (5%), új vagy meglévő fürdőépület kivitelezésében (5-5-5% a különböző szakterületeken), valamint a kötelező 24 hónapon felül vállalt többlet jótállás időtartama (10%). A kivitelezőnek szerepelnie kell az építőipari kivitelezési tevékenységet végzők névjegyzékében, és az elmúlt 3 lezárt üzleti évben legalább 1,8 milliárd forint árbevétellel kell rendelkeznie magasépítési kivitelezési tevékenységből, továbbá a saját tőkéje nem lehetett negatív legalább két évben. Referenciaként legalább egy, 1000 m2 alapterületű új fürdőépület építésére vagy meglévő fürdőépület felújítására/rekonstrukciójára/bővítésére vonatkozó generálkivitelezési feladat, valamint legalább egy, 1000 m2 alapterületű műemlék épület felújítására/rekonstrukciójára/bővítésére vonatkozó generálkivitelezési feladat igazolása szükséges az elmúlt öt évből.

A meglévő védett műemlék épületben feladat a medence-terek padozatának részleges bontása, valamint a gépészeti és épületvillamossági rendszerek átalakítása, a tartószerkezeti rendszerek megerősítése, továbbá a műemléki értéket képviselő elemek (fa, fém, kő, műkő, stukkó, stb.) restaurálása. Bontásra kerül a földszint és emeleti szint közötti födémek padló rétegrendje, a földszinti válaszfalak és a medencék burkolata a tartószerkezet fölső síkjáig, valamint a medencék vízelvezetésének elemei, továbbá a bontási terveken jelölt poroszsüveg boltozatok. Az előzőeken túl elbontásra és cserére kerülnek a beépített bútorok, szaniterek, belső és külső nyílászárók az építéskori és a farestaurátor által megtartandónak javasolt nyílászárók kivételével, szaunák bútorai, radiátorok és gépészeti takaróelemek az érintett területeken. Az épületben az épületgépészeti vezetékek cseréjét, javítását, ideiglenes kiváltását a Fürdő folyamatos működését biztosítva kell elvégezni. The economic and financial standing of the tenderer required for the performance of the contract can be proven as follows: P.1 Based on Section 65 (1) a) of the Public Procurement Act and Section 19 (1) c) of the Decree, a declaration of the turnover - calculated without VAT - from the subject of the public procurement (high-rise construction activity) for the 3 financial years preceding the publication of the call for tenders, depending on when the tenderer was established or started its activity, if these data are available. If the tenderer does not have the document according to condition P.1 because it operates in a legal form for which it is not possible to submit a declaration of turnover, it may prove its financial and economic standing with any other declaration or document deemed appropriate by the contracting authority instead of the named eligibility requirement and method of proof. The affected tenderer must, when requesting additional information, substantiate that it operates in a legal form for which it is not possible to submit a declaration of turnover and must request information regarding the named eligibility condition on the method of proving eligibility accepted by the contracting authority instead of the eligibility requirement and method of proof. The prescribed eligibility requirement can be met by joint tenderers according to Section 65 (6) of the Public Procurement Act. The economic and financial standing of the tenderer required for the performance of the contract can be proven as follows: P.2 Based on Section 65 (1) a) of the Public Procurement Act and Section 19 (1) b) of the Decree, by submitting the tenderer's own or its legal predecessor's financial statements (balance sheet, income statement, supplementary notes) for the previous 3 financial years, if the law of the country where the economic operator is established requires their publication. OR, if it is a tenderer not established in Hungary, it cannot submit a certificate (extract) or other certificate or declaration according to the registers listed in Annex XI of Directive 2014/24/EU of the European Parliament and of the Council to the contracting authority.

Bath*: According to Section 2 (22) of Government Decree 510/2023 (XI. 20.) on the establishment and operation of public baths, this means a facility currently classified as a type 1 public bath ("baths of settlements, sports swimming pools, training swimming pools providing infant swimming and therapeutic activities for small children, thermal baths, adventure baths, water and aqua parks, where water-related activity is the main mode of use, or is present alongside the main mode of use, in such a way that it can be used as an independent service for users").

M.1 (first part of text) The technical and professional suitability of the tenderer required for the performance of the contract can be proven as follows: M.1 based on Section 65 (1) b) of the Public Procurement Act and Section 21 (2) a) of the Decree, the tenderer can prove its suitability by presenting its most significant construction investments completed with successful technical handover within five years (60 months) preceding the publication of the call for tenders [taking into account Section 22 (3) of the Decree, with a certificate issued or signed by the other party to the contract]. The tenderer is unsuitable if it does not have at least 1 reference for the general contracting of the renovation and/or reconstruction and/or extension of a monument** building with a floor area of at least 1000 m2, completed with successful technical handover within five years (60 months) preceding the publication of the call for tenders. In the case of this requirement, the floor area requirement refers to the actually monument-classified built area. The M.1.2 minimum requirement can be proven by adding the floor area values of several (maximum 2) reference contracts, provided that each separately presented reference complies with the prescribed alternative requirements in all respects, except for the minimum area value. Monument**: In respect of Hungarian monuments, this means the concept according to Section 16 (82) of Act C of 2023 on Hungarian architecture. Taking into account the provisions of Section 34 (4) of Government Decree 322/2015 (X. 30.), the contracting authority refers to the fact that if a previous construction investment performed outside Hungary is presented for the proof of eligibility, a monument means a monument classification or an equivalent classification according to the legal system of the given country.

M.2 (first part of text) The technical and professional suitability of the tenderer required for the performance of the contract can be proven as follows: M.2 Based on Section 65 (1) b) of the Public Procurement Act and Section 21 (2) b) of the Decree, by naming the experts, their qualifications, and professional experience whom the tenderer intends to involve in the performance. The tenderer must submit a declaration using the form available in the EKR on the persons of the experts to be involved within the framework of eligibility, indicating the minimum requirement to be proven (M.2.1 and/or M.2.2 and/or M.2.3 and/or M.2.4 and/or M.2.5 and/or M.2.6 and/or M.2.7). The declaration must state, in addition to the expert's name and date of birth, the organization with which the expert is in a legal relationship, and the expert's current legal relationship with the designated organization (in the case of an organization involved by a capacity provider, the capacity provider organization must be named and the legal relationship between the expert and the capacity provider organization must be named, e.g., employment). In the event that the tenderer makes an offer greater than 0 for any of the evaluation criteria 2-5, the declaration must be submitted already within the framework of the tender in respect of the expert affected by the evaluation criterion, in order for the contracting authority to be able to determine which expert is presented for which position. In the event that the names of the experts to be presented in respect of the M.2.1-M.2.4 eligibility minimum requirements are not provided within the framework of the tender, the contracting authority will not consider this a deficiency if no additional experience offer is associated with the given expert(s). The names of such expert(s) must be provided at the latest at the request according to Section 69 (4) of the Public Procurement Act using the above form available in the EKR. Further documentation to be attached: - a simple copy of the document proving the expert's prescribed qualification (except if the given expert already has the prescribed authorization defined below according to Government Decree 266/2013 (VII. 11.) (266.KR) - in this case, its submission can be omitted, however, the relevant qualification must be referred to in the professional CV), - the expert's availability declaration (regarding that he/she will be available during the performance of the contract), - a professional CV signed by the expert himself/herself, describing the professional experience (in the case of experts according to M.2.5-M.2.6-M.2.7 eligibility requirements, we waive the obligation to submit a CV). The professional CV must detail - with dates (year/month accuracy) - the professional practice performed by the expert. The contracting authority understands professional practice as work experience based on employment in a position corresponding to the qualification, after obtaining the relevant qualification. If the expert participated in several projects at the same time, the number of months of practice gained during each project cannot be added up, i.e., a maximum of 12 months can be counted in a year, regardless of whether the expert worked on several projects at the same time. If the expert already has the authorization according to the given (M.2.1-M.2.4) minimum requirement - in addition to the fact that the submission of a simple copy of the document proving the expert's prescribed qualification can be omitted in the tender - it is not necessary to present the professional experience required to obtain the authorization in the professional CV, however, the expert's chamber (member) number and the exact date of obtaining the relevant authorization (with year/month/day detail) must be indicated. (In respect of any related evaluation criterion offer, the contracting authority accepts additional experience in the period after obtaining the authorization.) The prescribed eligibility requirement can be met by joint tenderers according to Section 65 (6) of the Public Procurement Act (in such a way that only one of them proves compliance in respect of the given expert(s)). When proving eligibility, the tenderer may rely on an organization providing capacity based on Section 65 (7), (9) and (12) of the Public Procurement Act. The contracting authority also intends to refer to the provisions of Section 69 (11) of the Public Procurement Act. In its tender, the tenderer is obliged to submit only its declaration contained in the ESPD regarding compliance with the eligibility requirements, taking into account the provisions of Section 67 (1) of the Public Procurement Act and Section 1 (1) of the Decree. The contracting authority, also referring to the provisions of Section 2 (5) of the Decree, draws attention to the fact that in this procedure, tenderers only need to prove their eligibility (preliminarily) by marking section "α" of the ESPD. The actual proof of compliance with the eligibility conditions may take place at the request of the contracting authority according to the provisions of Section 69 (4) of the Public Procurement Act. Based on the review and evaluation [Section 69 (4) of the Public Procurement Act], the contracting authority will request the submission of eligibility certificates and declarations from the potentially winning tenderer(s) - or, according to its decision, the next potentially winning tenderer(s) [Section 69 (6) of the Public Procurement Act], and the economic operator(s) participating in the proof of eligibility - by setting an appropriate deadline. An exception to this is the proof of eligibility minimum requirements for which the tenderer makes an offer greater than 0 for any of the evaluation criteria 2-5.
Documentation Requirement
M.2 (first part of text) The technical and professional suitability of the tenderer required for the performance of the contract can be proven as follows: M.2 Based on Section 65 (1) b) of the Public Procurement Act and Section 21 (2) b) of the Decree, by naming the experts, their qualifications, and professional experience whom the tenderer intends to involve in the performance. The tenderer must submit a declaration using the form available in the EKR on the persons of the experts to be involved within the framework of eligibility, indicating the minimum requirement to be proven (M.2.1 and/or M.2.2 and/or M.2.3 and/or M.2.4 and/or M.2.5 and/or M.2.6 and/or M.2.7). The declaration must state, in addition to the expert's name and date of birth, the organization with which the expert is in a legal relationship, and the expert's current legal relationship with the designated organization (in the case of an organization involved by a capacity provider, the capacity provider organization must be named and the legal relationship between the expert and the capacity provider organization must be named, e.g., employment). In the event that the tenderer makes an offer greater than 0 for any of the evaluation criteria 2-5, the declaration must be submitted already within the framework of the tender in respect of the expert affected by the evaluation criterion, in order for the contracting authority to be able to determine which expert is presented for which position. In the event that the names of the experts to be presented in respect of the M.2.1-M.2.4 eligibility minimum requirements are not provided within the framework of the tender, the contracting authority will not consider this a deficiency if no additional experience offer is associated with the given expert(s). The names of such expert(s) must be provided at the latest at the request according to Section 69 (4) of the Public Procurement Act using the above form available in the EKR. Further documentation to be attached: - a simple copy of the document proving the expert's prescribed qualification (except if the given expert already has the prescribed authorization defined below according to Government Decree 266/2013 (VII. 11.) (266.KR) - in this case, its submission can be omitted, however, the relevant qualification must be referred to in the professional CV), - the expert's availability declaration (regarding that he/she will be available during the performance of the contract), - a professional CV signed by the expert himself/herself, describing the professional experience (in the case of experts according to M.2.5-M.2.6-M.2.7 eligibility requirements, we waive the obligation to submit a CV). The professional CV must detail - with dates (year/month accuracy) - the professional practice performed by the expert. The contracting authority understands professional practice as work experience based on employment in a position corresponding to the qualification, after obtaining the relevant qualification. If the expert participated in several projects at the same time, the number of months of practice gained during each project cannot be added up, i.e., a maximum of 12 months can be counted in a year, regardless of whether the expert worked on several projects at the same time. If the expert already has the authorization according to the given (M.2.1-M.2.4) minimum requirement - in addition to the fact that the submission of a simple copy of the document proving the expert's prescribed qualification can be omitted in the tender - it is not necessary to present the professional experience required to obtain the authorization in the professional CV, however, the expert's chamber (member) number and the exact date of obtaining the relevant authorization (with year/month/day detail) must be indicated. (In respect of any related evaluation criterion offer, the contracting authority accepts additional experience in the period after obtaining the authorization.) The prescribed eligibility requirement can be met by joint tenderers according to Section 65 (6) of the Public Procurement Act (in such a way that only one of them proves compliance in respect of the given expert(s)). When proving eligibility, the tenderer may rely on an organization providing capacity based on Section 65 (7), (9) and (12) of the Public Procurement Act. The contracting authority also intends to refer to the provisions of Section 69 (11) of the Public Procurement Act. In its tender, the tenderer is obliged to submit only its declaration contained in the ESPD regarding compliance with the eligibility requirements, taking into account the provisions of Section 67 (1) of the Public Procurement Act and Section 1 (1) of the Decree.
